Terms and Conditions
The information below provides an overview of key aspects regarding orders, payments, delivery, and the use of Fikkerts products. This is our most up-to-date Terms and Conditions document. By placing an order with Fikkerts, you agree to comply with these terms.
- Pricing and Products
1.1 All prices are based on the Fikkerts Price List prevailing at the date of the contract and are quoted exclusive of VAT.
1.2 Packaging may be updated at the Seller’s discretion.
1.3 Fikkerts products are made from natural ingredients, which may cause variations in texture, appearance, and botanicals.
- Orders and Delivery
2.1 The minimum order value for carriage-paid delivery within the UK mainland is £250.
Orders under £250 incur a delivery charge of £15.
2.2 Deliveries outside the UK are supplied Ex Works.
2.3 Deliveries are normally made within 14 days of receiving an order; however, the Seller accepts no liability for late deliveries.
2.4 Ex Works Deliveries and Storage – Ex Works (EXW) deliveries must be collected within ten (10) working days of notification.
Failure to do so will incur a storage charge of £7.50 + VAT per pallet per week and £5 + VAT for each pallet movement in and out of storage.
2.5 Risk in the goods passes to the Buyer upon delivery, but title to the goods remains with the
Seller until payment is received in full.
- Payment and Credit Terms
3.1 Payment is due strictly within 30 days from the date of invoice, unless prior agreement has been made in writing, and may be made via BACS or credit card.
3.2 Granting of credit terms is at the Seller’s absolute discretion.
3.3 The Seller reserves the right to charge interest on overdue accounts. No orders will be processed if an account is in arrears.
3.4 Buyers who fail to observe these terms may be required to pay pro forma for subsequent orders.
3.5 New customers must pay pro forma for their first order. Credit facilities may be considered only upon receipt of the proprietor’s full details, bank information, and two trade references.
3.6 Legal proceedings may be initiated to recover outstanding debts.
- Claims and Quantity Variations
4.1 Claims for damaged goods or short delivery must be notified within three working days of receipt.
4.2 Where goods are manufactured specifically for a Buyer, any shortage or surplus, charged pro rata, will be considered part of the contract execution.
- Postcode Protection
5.1 A postcode protection radius of three miles may be granted to stockists when requested, subject to eligibility and a minimum annual spend of £1,500 by the Buyer.
5.2 Post code protection is granted by product range, not across the entire brand.
5.3 Garden centres, Department stores and High Street Chains are not considered as part of the postcode protection radius for independent stores.
5.4 The Seller reserves the right to grant, deny, or rescind postcode protection at any time, regardless of eligibility.
- Resale Restrictions
6.1 The Buyer is strictly prohibited from selling Fikkerts products on any third-party online platforms, including but not limited to Amazon and eBay.
6.2 The Seller reserves the right to cancel the contract without notice if such activity is discovered.
- Default and Termination
7.1 The Seller may cancel orders, withdraw credit, or terminate the trading relationship if terms are breached, including but not limited to:
- Non-payment
- Resale on prohibited platforms
- Breach of postcode protection rules
- General
8.1 The Seller reserves the right to make changes to botanical ingredients, packaging, and formulations where necessary.
8.2 All contracts are entered into under English law and are subject to the jurisdiction of the English courts.
8.3 These Terms and Conditions constitute the entire agreement between the Buyer and the Seller.
